NIIKPU, as a member of the Russian Union of Industrialists and Entrepreneurs, took part in the survey "Prospects for the circulation of digital rights in Russia."

On January 1, 2021, the Federal Law of July 31, 2020 No. 259-FZ "On digital financial assets, digital currency and on amendments to certain legislative acts of the Russian Federation" came into force, which for the first time in Russia provides for the possibility of issuing digital financial assets (CFA ) - digital rights that allow you to create new financial instruments and tokenize business processes.


  • digital rights certifying: any monetary claims; the ability to exercise rights to equity securities; the right to participate in the capital of a non-public joint stock company;
  • the issue and circulation of digital assets is possible only in special information systems (for example, on the basis of a distributed register) under the supervision of the Bank of Russia;
  • can be issued by legal entities and individual entrepreneurs;
  • transactions with CFA are concluded through CFA exchange operators, which are included in the register of the Bank of Russia (they can be banks, trade organizers or legal entities that meet certain requirements);
  • under the law fall DFA, as well as hybrid digital rights, which simultaneously include digital financial assets and other digital rights.

Prospects for the use of CFA by Russian companies from various sectors of the economy (industry, finance, commerce):

  • attracting investments and financing by issuing CFA, including those secured by manufactured products;
  • optimization of business processes and interaction with business partners through the digitalization of monetary claims under contracts and obligations (the ability to ensure the offset of counter claims of counterparties, as well as a simplified assignment of rights of claims under transactions by transferring and exchanging DFAs);
  • digitalization of accounts receivable and the possibility of operational management of the free liquidity of companies by reducing the number of intermediaries;
  • other opportunities for digitalization of investment attraction tools, corporate finance and business process management mechanisms.


  • conducts a survey of Russian companies on the prospects and ways of using the CFA in their economic and financial activities;
  • monitors law enforcement practice and summarizes the proposals of Russian business to improve the legislation on CFA;
  • identifies the best business practices for using digital financial instruments in order to generalize and standardize them.

Currently, the registration process of the first operators in the field of digital financial assets turnover is being completed. Along with the implementation of the legislation on the circulation of utilitarian digital rights (tokenization of real assets - goods, works, services, results of intellectual activity), this will lead to the formation of complex systems within which it will be possible to perform transactions, moreover, using hybrid tokens that give the right to both financial and for real assets.
