The article “State and Law” (No. 7, 2019) published an article by an expert at NII KPU, an analyst at the Institute of Economic Strategies Sergei Lutsenko, “Slander - a category of value judgments”.

The author considers the features of the use of such a legal category as slander. A mandatory element of slander is the dissemination of knowingly false, disgracing another person information about specific facts. In the current legislation, libel is considered a criminal act. Criminal liability is excluded if a person who, in good faith, is mistaken, disseminates defamatory information that is untrue. Slander is more a subjective value judgment and closer to the issue of protecting honor and dignity. In turn, the truth of a value judgment cannot be proved. International practice addresses the issue of decriminalization of libel.
